elementor-size-default\">Mise en \u0153uvre du Protocole pour la Pr\u00e9vention et le traitement du Harc\u00e8lement Sexuel et Sexiste au travail<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ae5ea9d elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"ae5ea9d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"text-decoration: underline;\">L&rsquo;article 48 de la Loi organique 3\/2007, pour l&rsquo;\u00e9galit\u00e9 effective des femmes et des hommes,<\/span> \u00e9tablit l&rsquo;obligation de promouvoir des conditions de travail qui emp\u00eachent le harc\u00e8lement sexuel et le harc\u00e8lement fond\u00e9 sur le sexe et d&rsquo;\u00e9tablir des proc\u00e9dures sp\u00e9cifiques pour sa pr\u00e9vention et pour canaliser les plaintes de ceux qui en ont \u00e9t\u00e9 victimes.<\/p><p>Quel que soit le nombre d&#8217;employ\u00e9s, il est n\u00e9cessaire de mettre en \u0153uvre une proc\u00e9dure d&rsquo;action pour d\u00e9tecter et r\u00e9soudre les \u00e9ventuels harc\u00e8lements sur le lieu de travail. La proc\u00e9dure prend la forme d&rsquo;un PROTOCOLE d\u00e9finissant des lignes directrices pour identifier les situations de harc\u00e8lement, qu&rsquo;il soit moral, sexuel ou sexiste, dans le but de r\u00e9soudre une situation discriminatoire et de garantir les droits des victimes.<\/p><p>Le Protocole pour la pr\u00e9vention du harc\u00e8lement moral, sexuel et\/ou sexiste au travail est un document qui vise \u00e0 \u00e9tablir une action syst\u00e9matique dans ces cas. Par la voie du protocole, l&rsquo;entreprise \u00e9tablit \u00e9galement une d\u00e9claration d&rsquo;intention de tol\u00e9rance z\u00e9ro \u00e0 l&rsquo;\u00e9gard du harc\u00e8lement et l&rsquo;adoption de mesures visant \u00e0 faciliter son \u00e9radication.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-e9bda99 elementor-widget elementor-widget-heading\" data-id=\"e9bda99\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Obligation l\u00e9gale<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4e055e1 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"4e055e1\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>La Loi oblige toutes les entreprises, quel que soit le nombre de leurs employ\u00e9s.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-22a9050 e-flex e-con-boxed e-con e-child\" data-id=\"22a9050\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t<div class=\"elementor-element elementor-element-194740e e-con-full e-flex e-con e-child\" data-id=\"194740e\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5ae4f8c elementor-widget elementor-widget-heading\" data-id=\"5ae4f8c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Registre des r\u00e9mun\u00e9ration<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-511fb02 elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"511fb02\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"text-decoration: underline;\">Le D\u00e9cret-Loi Royal 902\/2020, du 13 octobre, sur l&rsquo;\u00e9galit\u00e9 de r\u00e9mun\u00e9ration entre les femmes et les hommes, d\u00e9veloppe par voie r\u00e9glementaire l&rsquo;article 28 du Statut des travailleurs, qui oblige toutes les entreprises, quelle que soit leur taille, \u00e0 \u00e9laborer un REGISTRE R\u00c9TRIBUTIF.<\/span><\/p><p>Le registre des <strong>r\u00e9mun\u00e9rations<\/strong> est constitu\u00e9 de <strong>toutes les personnes qui travaillent<\/strong> pour la soci\u00e9t\u00e9 en tant que salari\u00e9s, ind\u00e9pendamment de leur type de contrat, de leur anciennet\u00e9, de leur <a href=\"https:\/\/delaguialuzon.com\/fr\/conseil-en-ressources-humaines\/\">journ\u00e9e de travail<\/a> ou de toute autre circonstance, y compris les personnes qui ont une relation particuli\u00e8re avec la soci\u00e9t\u00e9. L&rsquo;article 5.0 du D\u00e9cret Royal 902\/2020, du 13 octobre, mentionne express\u00e9ment le personnel de direction, qui doit \u00e9galement \u00eatre inscrit au registre.<\/p><p>Le registre des r\u00e9mun\u00e9rations doit inclure les valeurs moyennes des salaires, des compl\u00e9ments de salaire et des paiements non salariaux per\u00e7us par le personnel de l&rsquo;entreprise au cours de la p\u00e9riode de r\u00e9f\u00e9rence, ventil\u00e9s par sexe et r\u00e9partis par groupes professionnels, cat\u00e9gories professionnelles, niveau, poste ou tout autre syst\u00e8me de classification applicable, et refl\u00e9ter chacun des \u00e9l\u00e9ments de r\u00e9mun\u00e9ration per\u00e7us par le personnel, tels que les primes d&rsquo;anciennet\u00e9, les participations aux b\u00e9n\u00e9fices, les indemnit\u00e9s pour travail de nuit, etc., y compris les paiements non salariaux tels que les indemnit\u00e9s ou les allocations pour les d\u00e9penses encourues en raison de l&rsquo;activit\u00e9 professionnelle.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d3cc71b elementor-widget elementor-widget-heading\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Selon la Loi 30\/2015, du 9 septembre, qui r\u00e9glemente le syst\u00e8me de formation professionnelle pour l&#8217;emploi sur le lieu de travail, pour la formation de leurs travailleurs, les entreprises disposent d&rsquo;un cr\u00e9dit annuel pour r\u00e9aliser la formation <strong>de leurs travailleurs<\/strong> d&rsquo;un montant <strong>minimum de 420 euros.<\/strong>.<\/p><p>Le montant du cr\u00e9dit de formation sera d\u00e9duit des cotisations de s\u00e9curit\u00e9 sociale correspondant au mois au cours duquel le cours est termin\u00e9.<br \/>Pour cela, les acad\u00e9mies de formation doivent \u00eatre accr\u00e9dit\u00e9es pour dispenser des formations subventionn\u00e9es aux entreprises et, \u00e0 la fin du cours, elles doivent d\u00e9livrer le rapport correspondant de la Fundaci\u00f3n Tripartita para la Formaci\u00f3n y el Empleo.<\/p><p>La <strong>date limite<\/strong> d&rsquo;utilisation de ce cr\u00e9dit est le <strong>31 d\u00e9cembre<\/strong> de l&rsquo;ann\u00e9e en cours.<\/p><p>Si le cr\u00e9dit de formation n&rsquo;est pas utilis\u00e9 avant la date susmentionn\u00e9e, il <strong>NE PEUT PAS<\/strong> \u00eatre report\u00e9 \u00e0 l&rsquo;ann\u00e9e
