New rules for short-term rentals in Spain: what changes from 1 July 2025?

From 1 July 2025, Spain will implement one of Europe’s most ambitious regulatory frameworks for short-term rentals, giving effect to Regulation (EU) 2024/1028 and developing Royal Decree 1312/2024.

The legislation creates the Single Rental Register and a Digital One-Stop Shop, with the aim of increasing transparency, combating fraud and improving oversight of the tourist and seasonal housing market.

Who is covered by the new regulation?

The registration obligation applies to all properties offered as tourist, seasonal or room-by-room rentals that are advertised on online platforms where rental contracts can be concluded remotely.

Platforms affected

This includes portals such as Airbnb and Booking, where reservation and payment are completed entirely online. Without the corresponding registration number, these properties will no longer be allowed to operate on such platforms from July 2025.

Exceptions to mandatory registration

Classified-ad portals, personal websites without a booking engine and offline channels (physical agencies, print advertising) are exempt because they do not allow contracts to be concluded remotely.

What is the Single Rental Register?

It is a centralised system managed by the Ministry of Housing and Urban Agenda that assigns a unique identification number to every property intended for short-term rental. This number must appear visibly in advertisements and contracts posted on digital platforms that enable remote contracting.

The Digital One-Stop Shop

The Digital One-Stop Shop will be the access point for submitting registrations, consulting data and carrying out related formalities, making official supervision easier and streamlining procedures for owners.

How to register a short-term rental

  • Application period: 2 January – 1 July 2025.
  • Where: via the College of Registrars and the Digital One-Stop Shop.
  • Required documentation: cadastral reference, exact address of the accommodation, and details on the type of rental (entire property or rooms).
  • Additional requirements: proof of compliance with fiscal, licensing, safety and health regulations at both national and regional level.
 

Once the application is approved, the owner will receive the registration number, which must be included in all listings posted on digital platforms that allow remote contracting.

Owners offering short-term rentals on digital platforms must:

  • Obtain and display the registration number in every advertisement and contract.
  • Comply with tax regulations, declaring income and paying the corresponding taxes.
  • Ensure the property meets local administrative regulations, which may require specific licences or permits.
